About Tome Fitness

Tome Fitness is a free, cross-platform mobile application for logging workouts, tracking progress, and building consistent training habits. It is a personal hobby project built and maintained by a solo developer in Spain. It has no commercial backing, no investors, no team, and no revenue of any kind.

The application is built with Flutter (Dart) for iOS and Android, with Firebase providing cloud synchronisation and push notifications. The source of the body-map visualisation is a custom-painted 19-muscle anatomy diagram rendered entirely within the app.

Operator

Non-Commercial Status

Tome Fitness is, and is intended to remain, entirely free. There are no advertisements, subscriptions, in-app purchases, premium tiers, donations, affiliate links, sponsorships, or any other revenue mechanism. The operator derives no economic benefit from the Service.

Spanish Law 34/2002 (LSSI-CE) imposes identification obligations on providers of “information society services.” That law implements EU Directive 2000/31/EC, which defines such services as those that form part of an economic activity (Directive 2000/31/EC Recital 18). Because Tome Fitness constitutes no economic activity, the operator’s position is that the mandatory identification obligations of LSSI-CE do not apply. This position is based on the statutory text and consistent academic commentary; it has not been confirmed by binding judicial authority in a case with this precise fact pattern. The identification information published here is provided voluntarily for transparency and to satisfy the GDPR data-controller identification requirement.

Intellectual Property

The name “Tome Fitness,” the application logo, all source code, the UI/UX design, the interactive body-map component, and all other original elements of the Service are the intellectual property of Oscar Buxton Carda, protected under applicable Spanish and international intellectual property law.
